2 Regulatory Framework
2.1
The use of this Website is governed, among others, by the following regulations, in so far as they are applicable:
2.2 LSSI:
Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.
2.3 GDPR:
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, “GDPR”).
2.4 LOPDGDD:
Organic Law 3/2018 of 5 December on Personal Data Protection and the guarantee of digital rights (Ley Orgánica 3/2018, de Protección de Datos Personales y garantía de los derechos digitales).

Management of land holdings and long term leases to third party hospitality and leisure operators. This includes, by way of example, land and properties leased to restaurant and entertainment groups operating concepts such as Nota Blu and Mamzel at Finca Besaya.
2.9 Prestige Expo Hospitality
Management of restaurants and event venues under “Besaya Group”, including restaurants and venues such as Malva Beach, Tikitano, Besaya Beach and El Paraíso del Mar.
2.10 Prestige Expo Real Estate
Promotion, development and commercialisation of high end residential and hospitality real estate, including projects such as Tyrian Residences, El Bosque Phase I and II, Noura Villas, villas in Cascada de Camoján (including Villa Cascada and Villa Mulliner), and previous projects such as Villa Cullinan in La Zagaleta and Golden 7 in Marbella.
2.11 Prestige Expo Marketing
Parent investor of Velmure Marketing S.L., a marketing and creative agency providing digital, creative and communication services to the Prestige Expo group and selected external clients.

All these divisions operate under the corporate and compliance framework of Prestige Expo S.L., which sets and supervises common governance, risk management and ethical standards.
3 Purpose of the Website
3.1
The Website is a corporate communication and information platform. Its main purposes are:
- Presenting the Prestige Expo group, its subsidiaries, brands and investment lines.
- Showcasing current and past projects, particularly in real estate development and hospitality.
- Providing general information about the group’s activities, philosophy, sustainability commitments and business areas.
- Making available, where appropriate, non binding marketing material such as brochures, renders, photographs and videos.
- Offering contact channels for investors, collaborators, clients and other stakeholders.
The information published on the Website has a general, informative and illustrative character and does not constitute a binding offer, professional advice or a contractual commitment, unless expressly indicated otherwise in specific sections or documents.
In relation to real estate promotions, detailed and binding information (plans, specifications, prices, conditions and legal documentation) will be provided at the appropriate time to interested parties, in compliance with Royal Decree 515/1989 and consumer protection regulations.
4 Acceptance of the Legal Notice and Terms of Use
4.1
Accessing, browsing or using the Website implies that the user has read, understood and expressly accepts this Legal Notice and the other applicable legal texts, including the Privacy Policy and the Cookies Policy.
If the user does not agree with any of the conditions set out here, they must refrain from using the Website.
The Website is intended for users who are at least 18 years of age. By using the Website, the user declares that they are at least 18 years old and that they have sufficient legal capacity to enter into binding obligations.
Prestige Expo S.L. reserves the right to modify, update or remove this Legal Notice, the design, structure or content of the Website and its services at any time, without prior notice, respecting where appropriate the obligations of transparency established by the LSSI.
5 Intellectual and Industrial Property
5.1 Ownership of content
All content made available on the Website, including but not limited to texts, articles, photographs, images, videos, audio, drawings, architectural plans, 3D renders, logos, trademarks, trade names, domain names, graphic design, user interfaces, source code, as well as any other material, is owned by Prestige Expo S.L. or used under licence from third parties and is protected by the Intellectual Property Law and other applicable regulations.
The reproduction, distribution, public communication, transformation, making available, extraction, reuse or any other form of exploitation, in whole or in part, in any medium or by any technical means, is expressly prohibited without prior written authorisation from Prestige Expo S.L. or the respective rights holder.
5.2 Limited licence of use for users
Prestige Expo S.L. grants users a non exclusive, non transferable and revocable licence to access the Website and view its content for strictly personal, private and non commercial purposes, subject to compliance with this Legal Notice.
Under no circumstances will it be understood that access to the Website or the user’s browsing entails waiver, transmission, licence or total or partial assignment of the aforementioned intellectual and industrial property rights.
5.3 Trademarks and distinguishing signs
The denominations “Prestige Expo”, “Besaya Group”, the commercial names of the group’s restaurants and projects, and the logos and brands displayed on the Website are registered or unregistered trademarks and distinguishing signs owned by Prestige Expo S.L. or third parties, duly licensed.
The use of these trademarks or similar signs is strictly prohibited without prior written authorisation.
6 Use of Material by External Collaborators
6.1
The use of Prestige Expo’s images, renders, videos, brochures or any other marketing or corporate material by external collaborators (for example, real estate agents, brokers, agencies or marketing partners) is governed by the following rules:
6.2 Prior written authorisation
- Collaborators must obtain prior written authorisation from Prestige Expo S.L. for any use of the material.
- Authorisation will normally be granted within the framework of a signed collaboration or commercial agreement.
6.3 Signed collaboration agreement
A valid and in force collaboration agreement must exist, which will regulate the authorised uses, channels, territories, duration and any other conditions.
6.4 Permitted channels
Unless expressly agreed otherwise in writing, the material may be used only in:
- The collaborator’s own website.
- The collaborator’s official social media profiles (for example, Instagram, Facebook, LinkedIn, YouTube), under their own brand.
6.5 Prohibited uses
The following uses are expressly prohibited, unless Prestige Expo has granted specific written authorisation:
- Publication or distribution of material on real estate portals or listing platforms (national or international).
- Upload of content to listing syndication networks, multi listing services, or similar systems of massive distribution.
- Integration of material in third party CRMs or property databases accessible by networks of agencies beyond the signatory collaborator.
- Use in mass email marketing, automated newsletters or bulk messaging tools, except where expressly authorised.
- Transfer, resale, sublicensing or sharing of material with third parties, other agents, networks or companies that are not direct signatories of the collaboration agreement.
- Any modification, retouching, cropping, overlay of logos or addition of other elements that substantially alter the original composition, quality or message, unless expressly permitted.
6.6 Correct use and integrity of material
- Material must be used in a way that respects its original quality, proportion and format and does not mislead the public regarding the characteristics of the project, in accordance with Royal Decree 515/1989 on information for the sale and renting of dwellings and with advertising regulations.
- It is forbidden to superimpose brands, texts or design elements that could suggest that the collaborator is the developer or owner of the project.
6.7 Mandatory source attribution
The origin of the material must be clearly indicated in the way Prestige Expo S.L. reasonably requires, for example:
- “Images courtesy of Prestige Expo”
- Or including the official project logo where provided.
6.8 Right to withdraw authorisation
Prestige Expo S.L. reserves the right to revoke any authorisation of use and to request the immediate removal of the material from any channel in case of:
- Breach of this clause or the collaboration agreement.
- Misleading communication or reputational damage.
- Expiry or termination of the collaboration.
In such case, the collaborator undertakes to remove the material within a maximum of 48 hours upon written request.
6.9 Monitoring and legal actions
Prestige Expo S.L. may monitor specialised portals, social media and other channels to detect unauthorised uses, and may take civil, administrative or criminal actions that may correspond to the defence of its intellectual property and image rights.
7 User Obligations and Prohibited Conduct
7.1
The user undertakes to use the Website, its content and services in accordance with the law, this Legal Notice, good faith and public order.
The user must abstain from:
- Reproducing, copying, distributing, making available or in any other way publicly communicating the content of the Website without authorisation.
- Using the Website for purposes that are illegal, harmful or that may damage the rights and interests of Prestige Expo S.L. or third parties.
- Introducing or spreading viruses, malicious code or any other physical or logical systems that may cause damage to computer systems.
- Attempting to access restricted areas of the Website, servers or systems of Prestige Expo S.L. by any means.
- Using the Website under a false identity, using the identity of third parties, or carrying out activities that may confuse the origin of messages or information.
Prestige Expo S.L. reserves the right to deny or withdraw access to the Website to users who fail to comply with these obligations.

8.2 Links to the Website from third parties
The creation of links to the Website from other pages or platforms is subject to the following conditions:
- The link must point to the homepage or to other publicly accessible pages, without framing or reproducing the Website within the linking site.
- It is forbidden to give the impression that Prestige Expo S.L. has authorised such link or that it supervises, approves or assumes the content or services of the linking site, unless an express agreement exists.
- The linking site must not contain information or content that is unlawful, contrary to morality, public order or damaging to the image and reputation of Prestige Expo S.L.
Prestige Expo S.L. may request at any time the removal of a link, without having to justify the decision.
9 Liability and Warranties
9.1 Availability and functioning of the Website
Although Prestige Expo S.L. will make reasonable efforts to keep the Website available and secure, it does not guarantee:
- The continuous availability and uninterrupted functioning of the Website.
- The absence of errors or deficiencies in the content.
- The absence of viruses or other harmful elements introduced by third parties.
Accordingly, Prestige Expo S.L. is not liable for damages that may arise from:
- Interruptions or temporary suspensions of the service due to maintenance, technical problems, force majeure or causes beyond its control.
- Security incidents derived from the user’s own systems, devices or networks.
9.2 Content and accuracy
The content of the Website is of a general and informative nature. Prestige Expo S.L. may update, modify or remove the information and material on the Website without prior notice.
With respect to real estate projects and promotions:
- Images, renders, sketches, decorative elements, furniture, landscaping and similar elements are illustrative and may not correspond exactly to the final result.
- Surfaces, layouts, technical specifications, qualities and equipment may be subject to modification for technical, legal, urban planning or design reasons, in accordance with applicable regulations.
- The binding conditions of any sale, lease or investment will be those set out in the specific contractual documentation and in the legally required information available at the sales office or at the place of commercialisation, in compliance with Royal Decree 515/1989 and consumer protection laws.
Prestige Expo S.L. shall not be liable for decisions taken by the user based solely on the information on this Website, without having obtained personalised professional advice or the complete contractual documentation.
9.3 User behaviour
Prestige Expo S.L. shall not be liable for:
- Content or opinions that users may publish through interactive tools, social media or third party platforms.
- Damages or losses arising from the improper use of the Website, breach of this Legal Notice or violations committed by the user.
The user shall be liable for any damages of any nature that Prestige Expo S.L. may suffer, directly or indirectly, as a consequence of the breach of the obligations derived from this Legal Notice.
10 Personal Data Protection

The collection and processing of personal data through the Website (contact forms, subscription, downloads, requests for information, events, etc.) will be carried out in accordance with:
- Regulation (EU) 2016/679 (GDPR).
- Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights (LOPDGDD).
The detailed information regarding the processing of personal data, including the identity of the data controller, purposes, legal bases, potential recipients, international transfers, retention periods and the exercise of rights by data subjects, is described in the separate Privacy Policy, which the user must read and accept, where appropriate.
In any case, personal data will not be processed for incompatible purposes or transferred to third parties without an appropriate legal basis and adequate information to the data subjects.
11 Cookies and Similar Technologies
11.1
The Website may use first party and third party cookies and other similar technologies.
The user can find detailed information about the types of cookies used, their purposes, conservation periods and configuration options in the separate Cookies Policy.
By configuring their browser and the cookies banner, the user can accept, reject or configure cookies at any time, except for those that are strictly necessary for the operation of the Website, as permitted by the applicable regulations.
12 Social Media and Official Profiles
12.1
Prestige Expo S.L. may maintain official profiles on social media platforms such as, for example, Instagram, Facebook, LinkedIn, YouTube or others.
The processing of personal data of followers and interactions through such profiles will be governed by:
- The terms and conditions and privacy policies of each platform.
- The internal rules and corporate policies of Prestige Expo S.L. in relation to its social media presence.
Prestige Expo S.L. is not responsible for content, comments or actions carried out by third parties on these platforms. It reserves the right to moderate, hide or delete content that is unlawful, offensive, promotional without consent, or contrary to the image and values of the group.
13 Security Measures
13.1
Prestige Expo S.L. will adopt the technical and organisational measures that are reasonably appropriate to guarantee the security and integrity of the information and systems used in connection with the Website, in accordance with GDPR and LOPDGDD requirements, taking into account the state of the art, the nature, scope, context and purposes of processing, and the risks to the rights and freedoms of data subjects.
However, the user acknowledges that there are no completely invulnerable systems and that the internet involves certain risks beyond the reasonable control of Prestige Expo S.L.
14 Nullity and Partial Invalidity
14.1
If any clause of this Legal Notice is declared totally or partially null, void or unenforceable by a competent authority, such nullity will not affect the remaining provisions, which will remain fully valid and enforceable.
The affected clause or clauses will be replaced by others that most closely reflect the original intention, in accordance with the applicable legislation.
15 Applicable Law and Jurisdiction
15.1
This Legal Notice and any relationship between the user and Prestige Expo S.L. in relation to the Website shall be governed by Spanish law.
Without prejudice to the rights that may correspond to users acting as consumers or users under consumer protection legislation, for the resolution of any conflict or dispute that may arise regarding the interpretation or application of this Legal Notice, the parties submit, expressly waiving any other jurisdiction that may correspond to them, to the Courts and Tribunals of Marbella (Málaga).
